Appointing the counsel of convict Pawan Gupta in this case, has given some time to prepare the case. Pawan is the only culprit in this case, Which has not yet filed curative petitions. On the delay in hearing the case, the court handed over a list of advocates to the Delhi Legal Services Authority (DLSA) to provide counsel to Pawan Gupta. But Gupta refused to take the services of the lawyers fixed in the list.
On the other hand, after hearing the petition of Vinay Sharma for almost two hours, the court said that the order in this case will be pronounced at 2 pm on Friday afternoon. Vinay has said in his petition that he has become mentally unwell due to 'alleged torture and abuse' in the jail. On behalf of the Center and the Delhi government, Solicitor General Tushar Mehta opposed the arguments of advocate AK Singh after observing all the relevant records, stating that all legal procedures have been followed in dismissing Vinay's mercy petition. The medical report of 12 February was also presented before the bench, According to which Vinay is completely healthy. AK Singh alleged that the Lieutenant Governor of Delhi and the Home Minister did not sign the recommendation to dismiss his mercy petition. The bench turned down AK Singh's request to review the mercy petition, after reviewing the record, the bench said that they had signed the recommendation to dismiss the mercy petition. The petition was filed by Vinay on Tuesday in the apex court after the mercy petition was rejected by the President. It also alleges that he was unlawfully kept aside, including violation of his fundamental rights in jail. The petition said that mentally ill health in the jail is a ground for conversion of death penalty to life imprisonment. The lower court has on January 31 ordered all convicts Mukesh Kumar Singh, Pawan Gupta, The hanging of Vinay Kumar Sharma and Akshay Kumar was banned. Currently all four convicts are lodged in Tihar Jail. Four of the six accused have been convicted of rape and murder in south Delhi from Nirbhaya on 16-17 December. Nirbhaya died on December 29, 2012 in a hospital in Singapore. Of these, Ram Singh committed suicide while the sixth accused was released in 2015 after being kept in a correctional home for three years because of his age.
